Hedlund's Illegal Immigrant Motor Vehicle Reforms Becomes a Law
The legislation requires any person that registers a car in Massachusetts hold a license, social security number, or other proof of legal residence.
The Massachusetts State Senate and House overwhelmingly voted Monday night to override Governor Deval Patrick’s veto of legislation put forward by Sen. Robert Hedlund, R-Weymouth, that prevents illegal aliens from registering or operating motor vehicles.
The legislation, which was initially passed as an amendment, requires any person that registers a car in Massachusetts hold a license, social security number, or other proof of legal residence. Currently the Registry of Motor Vehicles only requires applicants to include their name, address, proof of insurance, and date of birth on the application to secure a so-called “X” registration.
In vetoing the legislation, Governor Patrick claimed it would “force the Registry to identify and police undocumented people.” But Hedlund disagreed, saying that this legislation is “one of the more practical yet simple initiatives that has been passed in Beacon Hill in the last few years.
By overriding the Governor’s veto, Hedlund said the state is now a safer place because it will now be required to have a license or social security number to register a vehicle.
“This is a concrete measure that strikes at the heart of the support structure that allows illegal immigrants to register and operate motor vehicles all while avoiding prosecution for immigration violations,” Hedlund said in a written statement. “This is a victory for motorists in Massachusetts, for police officers in Massachusetts, for immigrants who are here legally, and for the families who lost loved ones because of illegal immigrant being allowed to register cars and then driving.”
In addition to the new requirement for registering a vehicle, the bill toughens penalties for those caught driving without a valid license, increasing the minimum fine from $100 to $500 for a first offense, and establishing a penalty of fine up to $1,000 for a second offense, and a fine of up to $2,000 for a third offense.
Senator Hedlund’s office has pointed out the following examples of how illegal immigrants can be dangerous on the road:
In October 2009, Richard Grossi was killed when Maria Leite, an unlicensed illegal immigrant, allegedly drove through a stop sign and a blinking red light before crashing into Grossi’s car.
In February 2011, Andrea Agosto was killed when Manuel Zaruma, an illegal immigrant, allegedly lost control of his friend’s car and spun into the opposite lane, smashing into the car in which Agosto was a passenger.
In August 2011, Nicolas D. Guaman, who was in the country illegally, was arrested after his vehicle allegedly struck and killed 23-year old Matthew J. Denice.
Just last month, Auricelli Braga, 32, an illegal alien from Brazil, was charged with motor-vehicle homicide following a two-car crash in Canton on June 24 which killed 64-year old grandmother Sara Escudero.
“These tragedies occurred because a loophole exists that enables people without driver’s licenses and without any sort of training to register get behind the wheel of a car,” Senator Hedlund said.

Mr. Holmes, I was speaking in regard to violations and the system currently in place to prosecute unauthorized drivers. I don't consider the RMV a legal system, I was referring to the courts.

I don't care whether illegal immigrants are more or less safe on the roads. They are here illegally and therefore should not be granted "legal" documents. I am tired of watching friends spend a DECADE to become American citizens only to have folks who can't stand in line like everyone else demand that they be treated like citizens. They are not and therefore should not be given licenses. Period.

Just something basic that people tend to look past. The word "Illegal" in the term "illegal alien". "Illegal means against the law, as in, by being here without passing through a legal border crossing or obtaining a visa like "legal aliens" do, you are breaking the law, every single second that you are on American soil. The, you drive a car without a license. Now you are breaking 2 laws, every single second that you are behind the wheel. In that situation, it is our duty as American citizens to make you feel as unwelecome as possible. Hi Mike, If you submitted comments that were offensive, regardless of what name you used, they were deleted. One can go through all the comments on this topic and other topics and see a range of opinions. I would hate to characterize the comments as liberal or conservative opinions. Have any of you read the court dockets lately? Every day there are 5-10 droning w/I a license and having no ins. or registration. This law will not stop this. It will increase it. I am in favor of any illegal alien that is arrested should be deported. No matter what the crime. But let's no pretend that this solves the problem

I agree with Mass51. I support and am in favor of any person who is illegal or undocumented should be deported. That being said I have no faith in the court system or the RMV to track this or the police force or INS to enforce it. I went to a trade school that by law had to allow illegal aliens and they received grants and student loans but i didn't!!! Also, these illegal aliens either drove without a drivers license or got a drivers license in the state of Washington where they could get a license without giving a social security number. Many of them use fake social security numbers!! Wake up people!!! All of this legislation is a joke due to the loop holes allowed by the federal goverment and other state goverments and the fact that the right hand doesn't know what the left hand is doing. That is how 9/11 happened. All the INS needs to do is go to Nantucket and Martha's Vineyard and other resort towns to see that entire work force in these towns are full of illegal aliens!!!!

Hi Kelly, Being from Nantucket, I can tell you that the entire work force is not made up of illegal aliens. I am sure the same is true of the Vineyard. On Nantucket there are documented foreign workers, who come into the country legally with visas. Living on a small island, it would be difficult to hide as an illegal alien. That said, there are some illegal aliens, and many were deported in 2008, at least those with criminal records. Foreign workers who are documented, mostly with student visas, do jobs that frankly many Americans would not do. I will say that on the Cape and Islands, the year-round teenagers and college students do work during the summer, but it is rare to see vacationing high school and college students who are on the islands or Cape, living with their families in their second or third homes, working a summer job. These young people are off sailing and playing tennis! In decades past, they would have lined up for a summer job, but don't appear to be interested in washing dishes, shaking sheets or pulling weeds.

I do not see why any citizen would protect the illegals. We have a process to become a citizen of the is country, and yes it take some effort. Why should they enjoy the benifits of a citizen without the effort?

In Massachusetts, you do have to prove that you are an American citizen in order to register to vote. You must provide your birth certificate or other proof that you are a naturalized citizen. When you go to the polls, you must state your name and address. If you're not on the list, your vote is accepted, but your ballot is separated from ballots proven to be valid.

I am amused by the stories people use that "well my illegal alien friend drives better than me so he should have a license" The only point that makes to me is maybe that person should not have their license themselves, if they are admittedly a bad driver. But I will give an example of why that is a terrible argument.

My illegal alien friend who was trained by the taliban and hates America should be given a license to carry because he is a better shot than me. If you agree with that argument then I will agree with the argument that an illegal alien should be able to have a driver's license

Margaret, I am currently in a trade school that has atleast 2 illegal aliens that I know of and both of them live on MV. Both of them do not have valid social security numbers and one got her drivers license in Washington State. My point is that I know at least 2 people personally that are illegally in this country that not only have a driver's license BUT recevied federal grants to attend a school that I could not even get a loan from because although I am a USA born citizen, but my household income is too high. Also, the 2 people I am talking about both live on MV and they both recently got their Esthetician licenses from the state of MASS which on the application ask for a social security number. Do you get my point Margaret??????

Also, the 2 people I am referring to both have jobs on MV. Which means that their employers are not checking to see if they have valid working papers. These people do not have work visas -- they came here illegally and are have children here that they are educating in our schools and thanks to GW Bush are allowed to stay here and be educated due to No Child Left Behind. They system is flawed and broken!! I have no faith that anhy legislation will change anything. And by the way, I am a democrat and consider by most a liberal. Fearing courtroom congestion is grounds to overlook enforcing laws would suggest we shouldn't bother prosecuting armed robbery or human trafficking? Why enfoce any laws and leave judges to vacation the entire year?
You can't borrow books from the library without a valid Mass. ID. Denying equal access to knowledge seems a far greater penalty than driving or voting but have the defenders of the undocumented raised their voices on that front? Anyone? I thought not.

Dear Daniel Sena, that is NOT what Mr. Hedlund is saying. The purpose of the legislation and is to stop illegal aliens from getting a drivers license. It has nothing to do with who is a better driver but who should be allowed to drive. A drivers license is a privilege. If you are illegal you are NOT entitled to this privilege. Lot of angry people around here...The article cites several vehicular homicides as evidence this law was needed, but this law will not prevent them. It is really more of a political play. If someone wants to drive a car bad enough they will, license or no.

The RMV is short-handed as it is. How are you going to feel when you have to take a full day off to do ANYTHING at RMV? And please don't say it's that way now, because it is not. Half a day max as of now.
